GENERAL TERMS AND CONDITIONS OF SALE

The website www.atelier19.net, is published by DECO SENS, a company (SARL) with a capital of 15,000 euros, registered in the Versailles Trade and Companies Register under number RCS 480 634 666, whose head office is located at 1 bis chemin du Prunay, 78430 Louveciennes.

 

This website www.atelier19.net provides online sales and deliveries of preserved rose bouquets. These general terms and conditions of sale apply to the terms and methods of sale that are valid for the sales area of the website www.atelier19.net.

 

Any confirmed order on the site involves full and complete agreement with these general terms and conditions of sale. These general terms and conditions of sale shall prevail over all other conditions contained in any other document, unless a prior written express derogation has been granted.

1. APPLICATION AND OPPOSABILITY OF THE GENERAL TERMS AND CONDITIONS OF SALE

The customer declares and acknowledges:

  • Understand the general terms and conditions of sale before placing an order and before validating payment.

  • All our deliveries, services and offers are exclusively based on these GTS, in the absence of any explicit and written agreement to the contrary.

  • The customer acknowledges having obtained all the information relating to his need before placing an order on www.atelier19.net.

  • Specific conditions may apply to certain products. In this case, the customer is informed in advance on the website. Any order implies the acknowledgement of the specific conditions applicable.

  • Deco Sens is entitled to update the general terms and conditions of sale at any time and will keep the customer informed on its website.

2. WEBSITE

The website www.atelier19.net ensures to share the following information with its customers:

​

  • the legal notices identifying the company and all information relating to the products offered for sale.

  • the prices of the products as well as the shipping costs related to the delivery.

  • an indication of the payment terms.

  • protection of the customer's personal data.

  • the availability or unavailability of a product.

  • the start and end date of an offer.

 

Deco Sens does not guarantee that the site will operate without failure or interruption and will not be held responsible for data transmission and connection problems or network unavailability.

Deco Sens is entitled to modify the website for commercial or technical reasons, without the customer being informed and without his consentement.

3. PRODUCTS

The products offered for sale are those presented on the website www.atelier19.net on the day of the customer's order, within the limits of the inventory. However, any updating error on the website, whatever its origin, does not engage the responsibility of Deco Sens, which cannot be held responsible for the cancellation of an order due to the running out of stock.

 

Deco Sens is very careful about the products’ presentation on the website www.atelier19.net which is complemented by one or more photos and a description of the materials and colours. This information is not contractual. The handcrafted manufacture of our products can lead to a discrepancy in colours, dimensions, textures and other product features. Furthermore, these characteristics may also be altered by the screens or web browsers used to view them.

The customer acknowledges that these elements are indicative and not contractual. Regarding personalized products, the customer acknowledges that all intellectual property rights relating to the personalized product belong exclusively to Deco Sens.

4. ORDER AND VALIDATION

Orders are only placed via the Internet.

​

The order is confirmed when the customer:  

  • Filled in the forms on the website accurately, completely and without errors. 

  • Has paid the price of the order and delivery costs by indicating his bank details in the secure form specially set up for this purpose.

  • Confirmed his order by clicking on the "Confirm my order" button.

When the order has been processed, a confirmation e-mail will be sent to the client.

​

However, it can occur that a product is out of stock. In this case, Deco Sens commits to notify the customer by email. The order will be automatically cancelled and refunded. Deco Sens is entitled to offer the customer an alternative product of the same quality and price.

5. PAYMENT AND BILLING

Prices are indicated in Euros and including VAT. If the VAT rate changes, the price will automatically be changed without any further notice than the due date of the new rate. French VAT applies to all orders delivered in metropolitan France.

 

Only credit card payments are accepted. Payments are made by credit card, via STRIPE, our payment service provider who ensures the security of the payments. Deco Sens has no access to your payment information.

6. DELIVERY FEES

The amount of shipping fees are not included in the purchase price and may vary depending on what destination you have chosen. They are detailed in the "Shipping and Returns" tab and available in the shopping cart section which is submitted to your approval before confirming the order.

For any order to a country outside the European Union, customs fees and other taxes may apply and be invoiced to the carrier by the recipient of the package. The amount of customs fees and other taxes is not the responsibility of Deco Sens, since it depends on the customs regulations applied in the country concerned. We suggest you contact your customs office to find out more about these fees.

7. DELIVERY OF YOUR ORDER

Our bouquets are handmade on request and shipped from Monday to Friday. Orders are made and sent the same day, if they have been carried out before 3 p.m., otherwise the next day (except weekends).

- Delivery area: Deliveries are possible in mainland France, in French Overseas Departments and Territories and in Europe (exhaustive list below) :

Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Germany, Hungary, Italy, Ireland, Malta, Latvia, Lithuania, Luxembourg, Netherlands, Norway, Poland, Portugal, Romania, Slovenia, Slovakia, Spain, Sweden, Switzerland and United Kingdom.

​

The products are delivered without any guarantee of delivery time. Standard delivery is made by La Poste, by "Colissimo Suivi" and express delivery by Chronopost.

​

- Delivery terms: Delivery is made to the delivery address provided by the customer, it being specified that this must be the residence address of the customer, a natural person of his choice or a legal entity (delivery to his company). No deliveries will be made to hotels or PO boxes.

​

The customer must provide the required information for delivery: full address (street number, building number, staircase number, access code, name or intercom number...) and a valid telephone number. 

​

La Poste and Deco Sens cannot be held responsible in the event of non-delivery due to incorrect or incomplete delivery information.

​

In case of abnormally long delivery times or non-receipt of the products, the customer can contact customer service within 30 days by email at contact@atelier19.net. An investigation will be opened at La Poste to locate your package, which may last up to 1 month.

 

Any parcel declared lost by La Poste will either be reshipped or refunded at the end of this investigation.

8. WITHDRAWAL RIGHTS - REFUNDS AND RETURNS

According to article L.221-18, you can use your right of withdrawal. We accept the return, at your expense, of any item purchased on www.atelier19.net if it is shipped within 14 days from the date of delivery of your purchases. The products must be returned in their original condition (including packaging), in perfect condition for resale and with a return number.

To obtain a return number, you can contact us by email at retours@atelier19.net , specifying the order number and the items concerned.

 

Returns are to be made by parcel post to the following address: Decosens – service retours Atelier 19- 1 Bis chemin du Prunay 78430 Louveciennes

If the customer does not comply with these return conditions, Deco Sens will not be able to refund the products concerned.

​

The refund of returned items is made after verification and registration of the return, within 15 days.

​

For the refund, Deco Sens uses the same payment method as the one used for the order, with the exception of gift cards.

​

For gift cards, a credit note will be generated.

9. CREDIT NOTES AND GIFT CARDS

Gift cards are valid for one year and credit notes for 3 months. Gift cards and credit notes are not refundable.

10. INTELLECTUAL PROPERTY

The composition of the www.atelier19.net website as well as all its components, texts and images presented are protected by intellectual property rights; their reproduction or representation, even in part, is prohibited and may constitute an counterfeiting offence.

11. PERSONAL DATA AND COOKIES

In accordance with the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify or contest data concerning him. This right can be requested by contacting our customer service by email at contact@atelier19.net.

Deco Sens has declared the registration of its files to the Commission Nationale de l'Informatique et des Libertés (CNIL) under number 1429562.

​

All Customer information is used only in the context of your business relationship with Deco Sens, these information are never resold.

 

The customer's banking information is not in our possession at any time. Transactions are entirely processed via STRIPE, our payment service provider that ensures the security of payments.

 

The user of the www.atelier19.net website is informed when arriving on the site uses cookies, which make it possible to record information relating to the computer's browsing on the website. These cookies are subject to acceptance by the user and are only installed after, the pursuit of navigation being equivalent to acceptance. 

12. APPLICABLE LAW, CONFLICTS

These General Terms and Conditions of Sale and all acts and transactions carried out hereunder are subject to French law and to French legislation. 

 

In the event of a dispute, the French courts shall have sole jurisdiction.
